OVERVIEW

Mynta Meds, LLC ("Mynta Meds," "we," "us") operates as a Florida DBA of Fortified Insurance Alliance, LLC, located at 7000 W Palmetto Park Rd, Ste 210, Boca Raton, FL 33433. Mynta Meds owns and operates the website located at MyntaMeds.com, along with any associated platforms or services we (or our affiliates) may make available now or in the future (collectively, the "Site"). Mynta Meds offers access to the Site, including all information, content, products ("Products"), and services ("Services") available through the Site, conditioned upon your acceptance of all terms, conditions, policies, and notices stated or referenced herein ("Terms of Service") and compliance with all applicable laws and regulations.

By accessing and using the Site or Services, you agree to be bound by these Terms of Service and all related policies. YOU MAY NOT ACCESS OR USE THE SERVICES IF YOU ARE NOT AT LEAST THE AGE OF MAJORITY IN YOUR JURISDICTION OF RESIDENCE.

Please read these Terms of Service carefully. If you do not agree with any part of these Terms, you must discontinue using the Site and Services immediately. Your continued use of the Site constitutes your agreement to these Terms.

ARBITRATION NOTICE: By accepting these Terms, you agree that disputes arising under these Terms will be resolved by binding arbitration. YOU AND MYNTA MEDS WAIVE THE RIGHT TO A JURY TRIAL OR PARTICIPATE IN CLASS ACTIONS. (See Section 13.)

SERVICES

We provide access to Products and Services, including prescription fulfillment and telehealth options. You must be at least the age of majority in your jurisdiction to use these Services.

1. Prescription Fulfillment Services

We connect users with licensed pharmacies ("Pharmacies") to fulfill prescriptions. Currently, prescriptions are fulfilled by Partell Pharmacy, located at 5835 S Eastern Ave STE 101, Las Vegas, NV 89119. By using these Services, you understand that Mynta Meds is not a pharmacy and does not endorse specific drugs or pharmacies. Mynta Meds sends traffic to nMeds.com to facilitate order fulfillment. Mynta Meds is not responsible for the quality, suitability, or reliability of the services provided by the Pharmacies.

2. Telehealth Services

Mynta Meds may connect you with third-party healthcare providers ("Providers") for telehealth services. These Providers are responsible for the medical advice, diagnoses, and treatments they offer. You understand that telehealth services may not replace in-person care. By using these Services, you agree to review and provide informed consent before any telehealth consultation.

Mynta Meds does not establish a physician-patient relationship. For emergencies, call 911 immediately.

PRODUCTS

1. Products Offered

We offer prescription and non-prescription products, including over-the-counter medications, vitamins, dietary supplements, and wellness products. All Products are for personal use and are non-refundable.

2. Prescription Products

Certain Products require a valid prescription. Prescriptions may be fulfilled through Partell Pharmacy or another pharmacy of your choice. By using the Site, you agree to abide by all applicable laws and use prescription Products as directed by your healthcare provider.

YOUR OBLIGATIONS

You are responsible for:

  • Maintaining the security of your account.
  • Providing truthful and accurate information.
  • Complying with all applicable laws and regulations.
  • Not engaging in prohibited activities, including unlawful use, spamming, or uploading malicious content.

We reserve the right to terminate your access for violations of these Terms.

USER-GENERATED CONTENT

Our Site may also contain user-generated content, including reviews, comments, and feedback ("User Content"). By submitting User Content, you represent and warrant that:

  • You are the sole author and owner of the intellectual property and other rights to the content.
  • Your content does not violate any applicable laws or infringe on any third-party rights.
  • Your content is accurate, non-defamatory, and lawful.

Mynta Meds reserves the right to monitor, edit, or remove any User Content at its sole discretion. By submitting User Content, you grant Mynta Meds a non-exclusive, royalty-free, perpetual license to use, modify, and display such content.

BILLING

Billing for all purchases and services provided through Mynta Meds is handled by nMeds. nMeds coordinates the processing of payments and ensures compliance with applicable healthcare regulations, including HIPAA. You agree to provide accurate and up-to-date purchase and account information for all purchases made through the Site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You will be responsible for any applicable sales, use, duty, customs, or other governmental taxes, levies, or fees due with respect to your purchase of Products or Services.

Some of our Products and/or Services may be available on a subscription basis. By enrolling in subscription services, you agree to pay for a minimum of three consecutive months of service. For these Products and Services, your payment account will be automatically charged as described for that Product or Service. You may cancel a subscription at least thirty days before the next monthly processing date of your subscription (after your initial commitment has concluded) by contacting us at info@myntameds.com.

Mynta Meds is not enrolled with or otherwise acting as a participating provider in any federal or state healthcare programs (i.e., Medicare, Medicaid) or in any other health plan or third-party payor program.

THIRD PARTIES AND LINKS

The Site may include links to third-party websites ("Third-Party Sites") or services. Mynta Meds does not control, endorse, or assume responsibility for any Third-Party Sites. Any interactions with these Third-Party Sites are solely between you and the third party. Mynta Meds is not liable for any issues arising from such interactions.

INTELLECTUAL PROPERTY

All content on the Site, except for user-generated content, is the exclusive property of Mynta Meds. You may not reproduce, distribute, or modify any content without explicit permission.

By submitting feedback or suggestions to Mynta Meds, you assign all rights to the feedback to Mynta Meds and agree that Mynta Meds may use it for any purpose without compensation to you.

DISCLAIMERS AND LIMITATIONS OF LIABILITY

1. Disclaimers

Services, Products, and the Site are provided "as is" and "as available." Mynta Meds disclaims all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.

2. Limitations of Liability

To the fullest extent permitted by law, Mynta Meds will not be liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount you have paid in the six months preceding the claim.

DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

If you believe any content on the Site infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA). Notices should include:

  1. A description of the copyrighted work claimed to be infringed.
  2. Identification of the material that is claimed to be infringing.
  3. Contact information, including an email address and phone number.
  4. A statement of good faith belief that the use is unauthorized.
  5. A statement under penalty of perjury that the information provided is accurate.

DISPUTE RESOLUTION

1. Binding Arbitration

In the interest of resolving disputes between you and Mynta Meds in the most expedient and cost-effective manner, you and Mynta Meds agree that every dispute arising in connection with these Terms will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms.

2. Waiver of Jury Trial and Class Actions

BY ACCEPTING THESE TERMS, YOU AND MYNTA MEDS ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. YOU AND MYNTA MEDS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Mynta Meds agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

3. Exceptions to Arbitration

Despite the provisions of this Section, nothing in these Terms will be deemed to waive, preclude, or otherwise limit the right of either party to: (a) bring an individual action in small claims court; (b) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (c) seek injunctive relief in a court of law in aid of arbitration; or (d) file suit in a court of law to address an intellectual property infringement claim.

4. Arbitration Procedures

Any arbitration between you and Mynta Meds will be settled under the Federal Arbitration Act and administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in a mutually agreed location or remotely, as applicable.

5. Fees

The payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules unless otherwise stated in this Section. If your claim for damages does not exceed $10,000, Mynta Meds will pay the filing fees unless the arbitrator finds that the claim was frivolous or brought for an improper purpose.

GOVERNING LAW

These Terms are governed by the laws of the State of Florida.
